These general terms of use (hereinafter, the “Terms of Use”) govern access to and use of the website operated by Nuigo SAS (hereinafter “Nuigo”) accessible at https://www.nuigo.net/uk as well as associated services (hereinafter collectively the “Services”).
By accessing the Site or using the Services, you accept these Terms of Use without reservation. If you do not accept these conditions, please do not use the Site.
I.Description of the Services
Nuigo offers in particular: content and tools relating to pest control and disinfection; a search assistant (“Find an expert”); connection with listed partner companies; spaces for partners and platform administration; optional paid services for professionals (visibility, subscriptions, promotional options).
Nuigo is a technical and commercial intermediary: on-site services are performed by third parties. Information displayed on company profiles comes from partners or public sources; it is updated regularly but may contain inadvertent errors.
II.Accounts and access
Some features require account creation or use of a secure link (magic link, one-time code). You undertake to provide accurate information and to maintain the confidentiality of your access credentials. Any activity carried out from your account is deemed to have been performed by you, unless identity theft is duly reported without delay to contact@nuigo.net.
Nuigo may suspend or close an account in the event of breach of these Terms of Use, fraudulent use, attempt to circumvent security measures, or for legitimate reasons (legal obligation, user protection).
III.Permitted and prohibited uses
You undertake to use the Services fairly, in accordance with their spirit and purpose.
The following are prohibited in particular:
- mass extraction of data (scraping), overloading servers or circumventing technical measures;
- publishing unlawful, defamatory, hateful, misleading content or content that infringes third-party rights;
- impersonating third parties or creating false profiles;
- sending unsolicited communications (spam) through the platform;
- using the Services to develop an unfair competing service or to infringe the privacy of third parties.
IV.Intervention requests and leads
When you submit a request, you authorise Nuigo to transmit it to partner companies likely to respond to your need, and to process associated data in accordance with our privacy policy. You guarantee that the information provided is truthful. Partner companies remain solely responsible for commercial offers they send you.
V.Reviews and user content
Reviews and content you publish must reflect a genuine experience. Nuigo may moderate, remove or reject any content that does not comply with these Terms of Use or applicable regulations. You grant Nuigo a worldwide, free, non-exclusive licence to host, reproduce and display such content on the Site and promotional channels linked to the Services.
VI.Intellectual property
The Site, its structure, its databases, trade marks, logos and graphic elements are protected. Any unauthorised use is prohibited. Third-party trade marks appearing on the Site remain their property.
VII.Hyperlinks
The Site may contain links to third-party sites. Nuigo does not control these sites and disclaims all liability regarding their content or privacy practices.
VIII.Availability and evolution
The Services are provided “as is”. Nuigo endeavours to ensure continuous availability but does not guarantee absence of interruption, error or vulnerability. Services may be modified, supplemented or withdrawn with reasonable notice where possible.
IX.Paid services
Subscriptions and purchases made by professionals are governed by our terms of sale, which prevail in the event of contradiction on financial and contractual aspects.
X.Limitation of liability
Within the limits permitted by applicable law, Nuigo shall not be liable for indirect or intangible damage resulting from use or inability to use the Services. Nuigo's liability, where engaged, shall be limited to proven direct loss.
Nothing in these Terms of Use excludes liability that cannot legally be excluded (in particular death or personal injury due to negligence, or fraud).
XI.Indemnity
You agree to indemnify Nuigo against any claim, damage or expense (including reasonable legal fees) resulting from your breach of these Terms of Use or your content, to the extent permitted by law.
XII.Personal data
Data processing is described in our privacy policy.
XIII.Applicable law and disputes
These Terms of Use are governed by the law of the United Arab Emirates. Disputes shall be submitted to the competent courts of Dubai, without prejudice to mandatory provisions applicable to consumers or international jurisdiction rules where applicable law does not permit derogation.
Before any proceedings, the parties shall endeavour to resolve their dispute amicably by contacting contact@nuigo.net.
XIV.Changes
Nuigo may modify the Terms of Use at any time. The last updated date is indicated in the document header. Use of the Site after modification implies acceptance of the new conditions, unless objection within the periods and forms provided by law where it requires it.
XV.Miscellaneous
If a clause is held invalid, the others remain applicable. Failure to exercise a right does not imply waiver. These Terms of Use constitute the entire agreement between you and Nuigo regarding use of the Site within their scope.
